Under the federal Fair Labor Standards Act (“FLSA”),
employers who require employees to work overtime are generally
required to pay them premium pay for such overtime work. Employees
covered by the FLSA must receive overtime pay of at least
one and one-half times their regular rate of pay for all hours
worked over forty (40) in a workweek.
Unfortunately, employers often violate federal law regarding
overtime pay. Sometimes the violations are intentional, and
sometime they are the result of an employer wrongfully classifying
employees as exempt from overtime based on their job duties.
Whether the violation is intentional or not, employees can
recover their back pay and additional amounts as damages under
the FLSA.
